The present general terms and conditions (hereinafter “GTC”) apply to all legal transactions made through Fold’s online shop www.getfold.ch. Fold reserves the right to change these GTC at any time. The version of the GTC valid at the time of order placement applies and may not be changed unilaterally for the respective order. By accessing the webshop www.getsold.ch we assume you accept these GTC in full. Do not continue to use the webshop www.getsold.ch if you do not accept the GTC stated on this page.
All prices quoted are net, in Swiss Francs, include value added tax (VAT). Fold reserves the right to change prices at any time. The prices stated in the online shop at the time of order placement apply.
The contract between you and Fold comes about after of your order and the acceptance of this order by Fold. The receipt of the automatically generated order confirmation to the e-mail address provided by you does not constitute a commitment that the product will be delivered. It solely notifies you that the placed order was received by the online shop. The contract between you and Fold is only valid with the explicit acceptance of the order by e-mail. Fold may refuse an order without reason. Your order is legally binding.
Together with the acceptance of the order, you are provided with a provisional delivery date. Fold is committed to provide up-to-date and precise information on availability and delivery times. However, production and delivery shortages may cause delivery delays. If delivery by Fold is delayed, you are entitled to withdraw from the contract as of the 30th calendar day from the originally scheduled delivery date. In such an event, Fold will refund you any amount paid in advance. No further claims towards Fold apply. For products that we have on stock, the delivery time within Switzerland usually is 2–7 workdays. For shipments outside of Switzerland the delivery time will be provided after the parcel has been handed over to the delivery provider.
Fold ships the products within 2–5 workdays after your order. Delivery within Switzerland is done with the Swiss Post. For shipments outside of Switzerland, Fold reserves the right to choose a different delivery method. The benefit and risk for the ordered goods are transferred to you once the parcel has been handed over to the Swiss Post or delivery provider.
Defects and Returns
There is no general right to return ordered products unless defective. You are obliged to immediately inspect the delivered products for defects and completeness and inform Fold by e-mail (firstname.lastname@example.org) of any defects within five calendar days after receipt of the delivery, at the latest. Later carried complaints will not be considered. You must retain the product in the condition it was delivered in and may not use it. Fold is entitled to replace the defective products with perfect products or against a refund in the amount of the purchase price of the defective products. Shipment costs for returns are at your expense and risk and will not be refunded. Should a damage occur during the transport to you, please document them with photos and immediately contact the delivery provider to let them know about the damage. Fold warrants for two-years from delivery date that the ordered product will be free from defects and fully functional. Fold shall provide warranty either by repairing the product free of charge; providing a partial or full replacement with an equivalent product; refunding at current value or, at maximum, at the original sales price at the time of order; providing cost reduction. Fold is not liable for damage resulting from storage, setting or use of products that is improper, unlawful or contrary to contract; failure to maintain and/or improper modification or repair of the products by you or a third party; force majeure, particularly natural hazards, moisture, shock and impact etc.
Payment must be made in Swiss Francs. We accept credit card and PayPal payments. Delivery is made only after receipt of the payment.
The ordered products remain the property of Fold until full payment of the purchase price.
Returning products free of defects
Fold grants you the right to return ordered products within a maximum of 10 calendar days after receipt. Shipment costs for the return of the products are at your expense and risk. Returnable items must be new, unworn and in its original condition, including label(s) and original undamaged packaging and be returned with the enclosed invoice. Products must be sent by registered post to the following address:
Damaged products cannot be returned or will be fully invoiced.
Repairs outside of the warranty
All repair costs outside of the warranty must be borne by you. Fold reserves the right to invoice you for the examination of the defect claimed as well as for shipping fees for all products showing no detectable defects or defects that are not covered by the warranty.
Place of fulfilment, jurisdiction and applicable law
All legal relations between Fold and you are subject to substantive Swiss law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply. With the acceptance of your order on www.getfold.ch a sale contract according to Art. 184 et seq. of the Swiss Code of Obligations comes about. Jurisdiction is Zurich 8003.
